Data deletion
On this page we explain, step by step, how to request that your personal data be deleted. The first thing is to work out which of the two cases applies to you, because we are not always the ones who decide about that data.
Two different situations
Before writing, check which of these two cases is yours. This is what gets confused most often and it determines who you need to approach.
- (a) You are an Inmopulsia client: an estate agency, or someone on its team, with an account on the platform. You can request the erasure of your account and its associated data by writing to [email protected].
- (b) You are an end customer of an agency: for example, you wrote over WhatsApp to an estate agency that uses Inmopulsia, or you filled in the form on its website. In that case the controller of your data is the agency, not Inmopulsia: Phygitalbond S.L. acts solely as data processor on behalf of that agency.
If you are an Inmopulsia client (agency)
Write to us at [email protected] from your account email address, asking to cancel and to have the data erased. Before deleting anything we will offer to export your information (portfolio, contacts and history) so you do not lose it, and once you confirm we proceed with the erasure.
If you are an end customer of an agency
You have two routes, and both are valid:
- Approach the agency you spoke to: it is the controller of your data and the one that decides about it.
- Write to us at [email protected]. We will pass your request on to the controlling agency, carry out the technical deletion on the platform following its instructions, and confirm it to you by email once it is done.
How to request it
Write to [email protected] with the subject “Data deletion” and include only the minimum detail needed to locate you:
- The phone number you wrote from, if the contact was over WhatsApp.
- The email address of your account or the one you wrote to us from, if the contact was through a form or by email.
- If you remember it, the name of the agency you spoke to. It is not essential, but it speeds things up considerably.
We do not ask for excessive documentation
You do not need to send a copy of an identity document or any other paperwork. We will only ask for additional verification if there is reasonable doubt about who is making the request and, in that case, we will tell you exactly what we need and why.
Response time
We will acknowledge your request as soon as possible and deal with it within the maximum period of one month provided for in Reglamento (UE) 2016/679 (RGPD/GDPR, the EU General Data Protection Regulation). If the request turns out to be particularly complex, that period may be extended by up to two further months; if that happens, we will tell you within the first month and explain why.
What is erased and what is not
- Your personal data is erased: contact details, conversation history, your record in the agency’s CRM and any other associated data that identifies you.
- What a legal obligation strictly requires may be kept —for example, invoicing and accounting records for the statutory tax periods— blocked and not used for any other purpose.
- Anonymised data may be kept (aggregate usage statistics) that no longer allows anyone to be identified and which therefore ceases to be personal data.
- Backups are overwritten in their usual cycles; until then they are blocked and are not used for anything else.
If the contact was over WhatsApp
Where the conversation took place over WhatsApp with an agency that uses Atiende, dealing with the request removes the history of that conversation stored on the platform, together with the associated phone number.
The copy of the conversation you have on your own phone is on your device and in your own WhatsApp account: we cannot delete it, you control it yourself from the app.
Other rights
In addition to erasure, you can exercise your rights of access, rectification, restriction of processing, objection and portability through the same route. You can find the details in the privacy policy.
Complaint to the supervisory authority
If you believe your request has not been handled properly, you have the right to lodge a complaint with the Agencia Española de Protección de Datos (the Spanish data protection authority, aepd.es), which is the competent supervisory authority in Spain.
