Privacy policy

Phygitalbond S.L. is committed to protecting your privacy. This policy explains how we process the personal information we collect through this website, in compliance with Reglamento (UE) 2016/679 (RGPD/GDPR, the EU General Data Protection Regulation) and Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD, the Spanish data protection act).

What information we collect

The only way this site collects personal data is the contact form, and only the data you write in it: name, email address, telephone number and agency (optional) and your message. Browsing the site does not build any profile about you: we use no tracking cookies and no analytics or advertising tools.

Purpose of the processing

We use the form data solely to answer your enquiry, handle your demo request and, if the conversation continues, maintain our commercial relationship with you. We do not use your data to send you unsolicited promotional communications, nor do we disclose it to third parties for commercial purposes.

Legal basis

The legal basis for the processing is the explicit consent you give by ticking the acceptance box on the form before sending it, and the legitimate interest in dealing with the request you yourself send us.

How the form is sent

This site is static and does not store your data on servers of its own. The form is delivered through the FormSubmit service (formsubmit.co), which acts as the processor for the transmission and forwards your message to our mailbox. Any data you send us through WhatsApp or by direct email is also governed by those platforms' policies.

Your rights

As the data subject, you may exercise at any time your rights of access, rectification, erasure, restriction of processing, objection and portability by writing to [email protected]. You also have the right to lodge a complaint with the Agencia Española de Protección de Datos (the Spanish data protection authority, aepd.es).

Data security

We apply appropriate technical and organisational measures to prevent unauthorised access to or disclosure of your personal data. All traffic on this site travels encrypted (HTTPS).

Data retention

We keep the form data for as long as a commercial relationship exists or until you request its erasure, always within the periods established by the legislation in force.

Preferences saved in your browser

The site saves in your browser's local storage only usage preferences (for example, the light or dark theme chosen). That information does not leave your device and you can delete it whenever you like from your browser settings. More detail in the cookie policy.

WhatsApp messaging (Atiende)

Inmopulsia's Atiende product lets client estate agencies serve their own end customers over WhatsApp with the help of an AI conversational agent. In that context, Phygitalbond S.L. acts as a data processor on behalf of the agency (which is the data controller for that data), not as controller: end-customer data (phone number and message content) is processed to generate automated replies and manage the conversation, using AI providers (Anthropic, OpenAI) as sub-processors.

Messaging is provided over the WhatsApp Business platform operated by Meta Platforms, Inc., which acts as the messaging infrastructure provider and processes data under its own terms and privacy policy. Each client agency signs a data processing agreement with Phygitalbond S.L. governing this use, in accordance with Article 28 GDPR.

This data is kept for as long as the relationship between the agency and its end customer lasts, and is deleted in accordance with the instructions of the controlling agency or when the service contract ends.

Providers and international transfers

To provide the service we rely on providers acting as processors or sub-processors: Supabase (database and storage), Railway (application hosting), and Anthropic and OpenAI (artificial intelligence models that generate the automated replies and transcribe voice notes). WhatsApp messaging is provided over the platform operated by Meta Platforms, Inc.

Data is hosted on servers located in the European Union (Germany and the Netherlands). However, these providers are US entities and may access the data remotely from the United States for support and maintenance purposes, and the artificial intelligence model processing takes place in the United States. Those transfers rely on the Standard Contractual Clauses approved by the European Commission and, where applicable, on the EU-US Data Privacy Framework.

The Inmopulsia tools

Each Inmopulsia product (CRM, Atiende, Webs…) runs on its own domain and processes its users' data in accordance with its own privacy policy, which is shown at the time of registration.
