Terms of service
These terms govern access to and use of the inmopulsia.com website and the contracting of the Inmopulsia platform services. By using the site or contracting any of the services, you accept what is explained here. They are written to be understood: if anything is unclear, write to us at [email protected].
Purpose
Inmopulsia is a SaaS platform for estate agencies, owned by Phygitalbond S.L., bringing together several products: CRM, Captia, Resuelve, Atiende, Studio and Webs. These terms govern both access to and use of this website and the contracting and use of those services.
Each product may additionally have its own particular terms on its own domain. In the event of any conflict, the particular terms of that product prevail.
Who may contract
Inmopulsia services are aimed at professionals and companies in the real estate sector, not at end consumers. By contracting, you declare that you are acting in the course of your professional or business activity and that you have sufficient legal capacity to bind the company on whose behalf you are contracting.
Accounts and credentials
To use the platform, access accounts are created in the name of your agency and of the people on your team. Regarding those accounts:
- You are responsible for the accuracy of the data you provide when setting up the accounts and for keeping it up to date.
- Credentials are personal and non-transferable: you must keep them safe and not share them outside your team.
- You are responsible for the activity carried out from your accounts.
- If you suspect that someone has gained access without authorisation, tell us as soon as possible at [email protected] so we can block that access.
Acceptable use
When using the platform you undertake not to:
- Send spam or commercial communications to people who have not given their consent.
- Publish or process unlawful or misleading content, or content that infringes third-party rights.
- Attempt to access other agencies' data, tamper with the security of the platform or reverse-engineer the software.
- Use the platform for purposes other than those agreed, or resell or transfer it to third parties without prior written agreement.
WhatsApp and recipient consent
Use of the Atiende product and of any messaging feature is additionally subject to the Meta and WhatsApp Business policies, which prevail over these terms in everything concerning that channel.
You are responsible for holding the prior consent (opt-in) of the people you contact, for identifying yourself correctly as an agency and for handling opt-out requests without delay. Breaching Meta policies may lead the provider itself to suspend the line or the account, which is outside our control.
Third-party services
The platform relies on external providers: Meta and WhatsApp Business for messaging, artificial intelligence providers (Anthropic, OpenAI) for automated replies, and hosting and infrastructure services. The availability and behaviour of some features depend on those providers and on their own terms, which may change. We will make reasonable efforts to warn you of changes that affect you.
Price and billing
Prices, payment terms and all other financial conditions are agreed in each client’s proposal or contract: these terms do not set any price. Unless otherwise agreed, fees are invoiced in advance and applicable taxes are added to the invoice.
Term and cancellation
The term of the service is the one set out in your proposal or contract. You can request cancellation by writing to [email protected], observing the agreed notice period.
On cancellation you may request the export of your data and its erasure. How to do so is explained step by step on the data deletion page.
Availability and support
We work to keep the platform continuously available, but we do not guarantee an uninterrupted or error-free service. We carry out maintenance and updates that may involve occasional interruptions: when these are planned and significant, we will try to give advance notice and to run them at times of lower usage. Support is provided through the channels stated in your contract.
Intellectual property
The platform, its software, its design, its documentation and its trade marks are the property of Phygitalbond S.L. Contracting the service grants you a non-exclusive, non-transferable right of use for the duration of the contract; it does not transfer ownership of the software to you.
The data and content you upload to the platform —your property portfolio, your contacts, your texts and images— remain yours. We only process it in order to provide the service to you and in accordance with your instructions.
Liability
We are liable for direct damages arising from a breach on our part, subject to the reasonable limit of the amount invoiced for the affected service during the twelve months preceding the event causing the damage. We are not liable for loss of profit or indirect damages, nor for the consequences of any use of the platform contrary to these terms, nor for failures attributable to external providers or to force majeure.
Nothing above limits liability that the law does not allow to be limited, such as liability arising from wilful misconduct or gross negligence.
Data protection
The processing of personal data is explained in the privacy policy. As regards the data of the agency’s own end customers —for example, someone who writes over WhatsApp to an estate agency that uses Inmopulsia—, the agency is the data controller and Phygitalbond S.L. acts as data processor on its behalf, in accordance with Article 28 of Reglamento (UE) 2016/679 (RGPD/GDPR, the EU General Data Protection Regulation). Each client signs the corresponding data processing agreement.
Changes to these terms
We may update these terms to adapt them to legal, technical or service changes. If the change is significant we will notify you with reasonable advance notice, by email or from the platform itself, before it takes effect. If you do not agree, you may cancel in accordance with your contract.
Applicable law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals having jurisdiction under the law.
